Welcome to LucasRentals.com (the “Site”). These Terms of Use (the “Terms”) govern your access to and use of the Site and the services provided by Lucas Rentals (“Lucas Rentals,” “we,” “our,” or “us”). By browsing the Site, creating an account, submitting an application, or using any feature offered by the Site (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

1) Scope of Services

Lucas Rentals is a real estate technology platform that helps prospective tenants discover rental opportunities and submit information to independent property owners and managers (“Property Owners”). We provide tools for property search, tenant screening, application submission, and secure communication between renters and Property Owners. We do not own, manage, or control the properties listed on the Site.

2) Important Disclosures About Our Business Model

  • Tenant Screening Service: We provide screening as a service to help Property Owners assess prospective tenants. Screening may include identity verification, employment and income checks, rental history checks, and other lawful review processes. Results are shared with the Property Owner at their request and subject to applicable laws.
  • No Contracts With Property Owners: Lucas Rentals does not enter into exclusive brokerage or property-management contracts with Property Owners. Property Owners are independent third parties and make their own decisions about tenant selection, pricing, and lease terms.
  • Referral & Commission: We may receive a fee or commission when we screen and forward tenants to Property Owners, or when an application leads to a signed lease. Any such fees or commissions are for facilitating introductions and providing screening and platform services. We do not act as an agent for tenants or Property Owners.

3) No Agency; No Legal Advice

Lucas Rentals is not a real estate broker, agent, legal advisor, or property manager. No part of the Services should be considered financial, legal, or housing advice. Property Owners and tenants should independently evaluate all information and seek professional advice as needed.

4) Eligibility & Your Account

  • You must be at least 18 years old (or the age of majority where you live) to use the Services.
  • When you create an account, you agree to provide accurate, current, and complete information and to update such information as needed.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • We may refuse, suspend, or terminate accounts for any reason consistent with law, including suspected misuse or violations of these Terms.

5) Tenant Applications & Screening

By submitting an application or other information through the Site, you authorize Lucas Rentals and the relevant Property Owner to use your information for screening and evaluation in accordance with our Privacy Policy and applicable laws. Screening may include identity verification and permissible checks to confirm eligibility for a rental. You represent and warrant that all information you submit is truthful, complete, and not misleading.

Fair Credit Reporting & Adverse Action

Where applicable, screening may involve third-party vendors. If a Property Owner relies on a consumer report in taking adverse action (e.g., declining an application), it is the Property Owner’s responsibility to provide any required notices under applicable laws. Lucas Rentals does not make tenant selection decisions and is not responsible for a Property Owner’s adverse action obligations.

6) Listings & Third-Party Property Information

Property listings are provided by Property Owners or third parties. We do not guarantee the accuracy, completeness, legality, or availability of any listing. Prices, terms, availability, and features are subject to change without notice by the Property Owner. You should independently verify all information before relying on it.

7) Fees, Payments & Refunds

  • Application Fees: Some Property Owners may require an application fee to cover screening or administrative costs. Fees are disclosed at checkout before you pay.
  • Payment Processing: Payments may be processed by third-party processors (e.g., PayPal or card processors). By paying through the Site, you agree to the processor’s terms and privacy policies.
  • Refunds: Refund policies are disclosed at or before checkout and may vary by Property Owner and transaction type. Certain fees may be non-refundable except where required by law.
  • Commission: Lucas Rentals may collect a referral or platform fee from Property Owners, as disclosed in our agreements with them, for screening and forwarding qualified tenant leads.

8) No Endorsement; No Guarantee of Tenancy

We do not endorse any specific Property Owner or property and make no guarantee that an application will be approved, that a lease will be offered, or that any particular property is suitable for your needs. All leasing decisions are solely between the Property Owner and the prospective tenant.

9) User Conduct

You agree not to use the Services to:

  • Violate any law or regulation, including fair housing, anti-discrimination, and consumer protection laws.
  • Submit false, misleading, or fraudulent information.
  • Infringe the rights of others, including privacy and intellectual property rights.
  • Attempt to gain unauthorized access to systems, data, or accounts, or to interfere with the operation of the Site.

10) Fair Housing & Anti-Discrimination

Lucas Rentals is committed to fair housing and equal opportunity. Property Owners are solely responsible for ensuring their listings, criteria, and tenant selection practices comply with applicable federal, state, and local fair housing laws. We reserve the right to remove content or suspend access for conduct that appears discriminatory or unlawful.

11) Content You Submit

You grant Lucas Rentals a non-exclusive, worldwide, royalty-free license to host, store, use, reproduce, and display content you submit solely for the purpose of providing the Services and operating the Site. You represent and warrant that you have all rights necessary to grant this license and that your content does not violate any rights of others or any laws.

12) Intellectual Property

The Site, including text, graphics, logos, and software, is owned or licensed by Lucas Rentals and is protected by intellectual property laws. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works from the Site or its content.

13) Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and share information. By using the Services, you consent to our data practices in accordance with the Privacy Policy.

14) Third-Party Services & Links

The Site may contain links to third-party services or websites. We do not control or endorse these third parties and are not responsible for their content or practices. Your interactions with third parties are solely between you and those parties.

15) Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT LISTINGS WILL BE ACCURATE OR AVAILABLE.

16) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUCAS RENTALS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICES; (B) ANY CONTENT OR CONDUCT OF ANY THIRD PARTY; (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION; OR (D) ANY INTERACTIONS OR TRANSACTIONS BETWEEN TENANTS AND PROPERTY OWNERS.

IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID TO US FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (II) ONE HUNDRED U.S. DOLLARS (US$100).

17) Indemnification

You agree to defend, indemnify, and hold harmless Lucas Rentals and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or relating to (a) your access to or use of the Services, (b) your content, (c) your violation of these Terms, or (d) your interactions with Property Owners or other users.

18) Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason consistent with law, including if we suspect fraudulent or unlawful activity or a violation of these Terms. Upon termination, your right to use the Services will cease immediately. Sections that by their nature should survive termination will survive.

19) Changes to the Services or Terms

We may modify the Services or these Terms at any time. We will post updated Terms on this page and revise the “Last Updated” date above. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

20) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State in which Lucas Rentals is organized, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in that state for any disputes arising out of or relating to these Terms or the Services. The parties waive any right to a jury trial to the extent permitted by law.

21) Communications; Consent to Electronic Notices

By creating an account or providing your contact information, you consent to receiving communications from us electronically, including emails, messages within the Site, or notices posted on the Site. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

22) Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Lucas Rentals concerning the Services.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent.
